뇌심혈관질환에 대한 산재보상 청구자료 실태 및 특성 분석

Abstract

본 연구는 2010년 뇌심혈관질환으로 산재보상 청구한 24시간 격일제 아파트 경비원의 사례들을 분석하여 업무상 질병 승인 여부에 영향을 미쳤던 요인들을 파악하기 위한 것이다. 2010년 1월 1일부터 12월 31일까지 1년간 근로복지공단에 뇌심혈관질환으로 산재보상 청구 후 승인여부가 결정된 사례 2,780건 중 24시간 격일제 근무, 아파트 경비원 요건에 해당되는 305건을 조사대상으로 하였으며, 이 중 자료내용이 부실하여 분류가 불가능한 경우를 제외한 215건의 자료를 연구대상으로 하였다. 연구방법은 기존 연구논문과 문헌자료를 통해 아파트 경비원 및 업무상 뇌심혈관질환의 인정기준에 대한 이론을 검토하였고, 업무상 질병으로 승인된 뇌심혈관질환과 승인되지 못한 뇌심혈관질환 사이에 어떠한 요인이 영향을 미치는지 파악하기 위해 위험요인으로 추정되는 변수별로 뇌심혈관질환의 승인과의 상관관계를 카이제곱 검정을 통해 분석하였다. 아파트 경비원이 뇌심혈관질환으로 산재보상 청구한 사례 214건 가운데 승인된 건수는 13건으로 승인율은 6.1%였다. 연령과 승인여부를 비교한 결과, 50-59세 50건 중 9건(18.0%), 40-49세 9건 중 1건(11.1%), 70세 이상 27건 중 1건(3.7%), 60-69세 126건 중 2건(1.6%)이 승인되었으며 통계적으로 유의한 차이가 있었다(p<0.05). 사업장 규모와 승인여부를 비교한 결과, 규모가 확인되지 않은 135건(63.1%)을 제외하면 50인 이상 사업장이 1건 중 1건(100%), 5인 미만 사업장이 39건 중 3건(7.7%)이 승인되어 평균 승인율(6.1%)보다 높은 수준이었으며 통계적으로 유의한 차이가 있었다(p<0.05). 발병 전 24시간 내 급격한 작업환경의 변화여부별 승인현황을 보면, 급격한 작업환경의 변화가 있는 경우가 54건 중 9건(16.7%)이 승인된 것에 비해 변화가 없는 경우가 160건 중 4건(2.5%)이 인정되어 급격한 작업환경의 변화여부에 따른 차이가 있었다(p<0.05). 자문의 소견별 승인현황을 보면, 자문의가 과로를 인정한 경우 13건 중 8건(61.5%), 불인정한 경우 194건 중 3건(1.5%), 자문의가 서로 다른 의견인 경우 4건 중 2건(50%)로 승인되었으며, 자문의 소견별 승인율은 통계적으로 유의한 차이를 보였다(p<0.05). 수면시간별 승인현황은 수면시간을 파악할 수 없었던 119건(55.6%)을 제외하면 수면시간이 1시간 미만인 경우 4건 중 1건(25%), 수면시간이 1-2시간인 경우 12건 중 3건(25%)이 승인되어 동일한 승인율을 보였으며, 4시간 이상인 경우 28건 중 2건(7.1%), 2-3시간인 경우 25건 중 1건(4.0%)이 승인되었으며, 수면시간별 승인율은 통계적으로 유의한 차이가 있었다(p<0.05).| The study was conducted for cases of cerebrovascular and cardiovascular diseases claimed for the Workers’ Compensation Insurance to identify the factors affecting approval of the claimed cases as compensable occupational diseases. The target cases of this study was cases of cerebrovascular and cardiovascular diseases claimed for the Workers’ Compensation Insurance among apartment guards who worked for 24 hours every other day in 2010. These cases were found 305 cases. After reviewing the records, 215 cases were selected for this study and 90 cases were discarded because of poor records. Selected cases were analyzed between the possible contributing risk factors and approval rate. The results of this were as follow. 1. Thirteen cases were approved as the compensable occupational diseases among 214 cases. Thus, the approval rate was 6.1 percent for the cases of cerebrovascular and cardiovascular diseases claimed for the Workers’ Compensation Insurance among the group of apartment guards. 2. Approval rates by the age group were statistically different. Age group of 50-59 showed highest the approval rate(18%). Approval rates for the age group of 40-49, 60-69 and >70 were 11.1%, 1.6% and 3.7% respectively. 3. It was assumed that sudden changes of working conditions and/or work environments might affected the approval rate for the compensable occupational diseases since the approval rates were shown statistical differences between two groups by the presence of sudden changes of working conditions and/or work environments before the incidence of the diseases. The approval rate in the group who had sudden changes was 16.7% but the other group who had no changes showed 2.5%. 4. It was found that the medical doctor’s comments or opinion on the records especially for the fact that the patient was suffered over-work or over-exertion might be the most influential factor for the approval. The approval rate in the group who had the medical doctor’s comment on the over-work or related comments was 50% and in the compared group having no comments it was dropped to 1.5%. 5. Sleeping duration time may be considered as another affecting factor. The approval rate for the 4 groups having sleeping for less than 1 hour, 1-2 hours, 2-3 hours and more than 4 hours during 24 work shift were found 25%, 25%, 4% and 7.1%. These results were statistically significant, however, it is still highly uncertain since the number of case was extremely small.
