일반경쟁 군수 조달품의 계약 및 품질보증제도 개선방안 연구

Abstract

본 연구는 정부조달계약 개념, 의의 및 절차와 계약의 종류에 관한 연구를 통해서 장, 단점을 분석 하였으며 국방조달 절차를 통해 정부조달과의 미국의 계약제도의 차이점을 알아보았다. 이를 통하여 품질에 대한 한국의 품질보증과 미국의 품질보증제도에서 비교하여 계약과 보완관계에 따라 발전방안을 찾고자 하였다. 한국에서의 계약제도의 문제는 계약담당자가 단순한 업체와의 계약서를 작성하는 것으로 생각하고 우선 계약만 하면 납품은 품질보증기관에서 알아서 처리하도록 하는 업무 자세와 단지 업무의 투명성을 위해 전문지식이 없는 인력이 투입되는 것이 문제점으로 사료된다. 즉 계약담당자는 계약관리에 대한 인식전환이 필요하고 양산단계에서 사업관리자로서 규격의 타당성과 업체의 생산가능 능력을 판단하고 납품 후 군의 운용성 고려 등 전반적인 검토를 해야 한다. 또한 계약이행을 효율적 추진하기 위하여 업체와 계약 전에 충분한 계약이행사항을 서로 소통하도록 노력해야 된다고 생각된다. 품질보증제도에 있어서도 한국의 품질보증제도는 미국의 품질보증제도를 따라 모방 적용하여 왔다 이러한 제도는 미국과 같은 계약제도와 사회적 신뢰환경이 뒷받침되어야 하나 그러하지 못한 것이 현실이다. 따라서 한국의 품질보증제도는 미국의 제도를 도입하되 무조건 도입할 것이 아니라 한국 현실에 맞는 세부적인 품질보증제도의 연구가 필요하다. 또한 계약제도와 품질보증제도는 매우 밀접한 관계를 가지고 있다. 계약담당자는 계약관련 법률과 규정에 부합되게 계약행위를 추진하는 것도 중요하지만 관련 법 안에서 융통성을 부여 할 수 있는 소신과 조달예비 판단 시 신규품목과 문제가 예상되는 품목에 대해서는 관련자들과 의사소통을 통해 문제의 소지를 미연에 방지해야 한다. 이를 위해서는 계약담당부서와 품질보증하는 부서가 정기적인 협력관계를 구축하면 많은 시행착오를 최소화 할 수 있으며 여기에서 제시한 개선방안으로 업무를 개선하면 양질의 군수품을 효율적으로 획득할 수 있을 것이다.| This study is intended to improve the Contracts and Quality Assurance Systems of Korea Defense with comparing and analysis of Korea and US of the Contracts and Quality Assurance Systems. As a result of analysis, the following conclusion was made : Firstly, Contract departments try to improve the bidding system in relation to specific contracting item in the contracts systems. It is made that supplier have the confidence and make the investment to improve the process and the quality. And need understanding between contracts and supplier for purchasing material. Gradually the contracts systems is enlarged to Contracts by Sealed Bidding in korea. Contract departments review the specific contracting item and choice the suitable supplier to make materials by Negotiation. If it need a special technique, Contract departments try to keep the Contracts by negotiation for 4~5 years and contract the supplier with Quality Product List(QPL) or Quality Manufacturing List(QML) by Limited Negotiation Secondly, Quality departments participate the process of the development including design steps prevent from the problem of manufacturing, quality. And try to improve the quality assurance system properly in which adapts the new system from US. For quality circumstance differ from each country. Quality departments strengthen the fully-life- cycle quality assurance for managing and sustaining the materiel to feed back the information of field support. Quality assurance engineers need to change the concept for quality because social quality level is growed up. if they have the content of mind which defense material is meet the specific requirement. Quality assurance engineers try to up grade the specific requirement and inspect more high level than general products And introduce system which the supplier continuously try to increase the improvement of products. In conclusion, there are intimately related with the Contracts and the Quality Assurance Systems. Although it is important that contract managers try to contract with supplier to meet the regulations and laws, but try to prevent the problem before contract with supplier above all apply the law as flexibility with their belief. And if the contract department between quality department need to co-network system to exchange the information, there will be reduced many problem as quality, delivery and cost.
