중소기업의 제조물책임(PL)과 대응력 제고에 관한 연구

Abstract

본 논문은 국내 산업에 중요한 위치를 차지하고 있는 중소기업이 제조물 책임(PL)으로부터 면역력을 가지고 원활한 경영활동을 추진하기 위한 효과적인 대응활동과 관련하여, 일정한 수준의 대응력 갖춘 기업으로 성장하기 위해서 우선적으로 추구해야 할 활동 현황 및 문제점을 살펴보고, 중소기업이 효율적으로 자사의 제조물책임(PL) 리스크를 합리적인 수준에서 관리할 수 있는 대응력 제고방안을 제시하는데 그 목적이 있다. 제품안전에 대한 시장의 요구수준 변화와 법적환경의 변화는 제품안전에 대한 새로운 인식과 더 한층 강화된 제품안전 확보를 위한 전문적인 활동을 요구하고 있다. 그러나이러한 활동들은 전문인력, 시간, 비용 등의 경영자원의 확보가 어려운 중소기업의 경우 대응에 한계가 있는 것이 사실이다. 또한 제조물책임 대응의 핵심활동인 제품안전확보 분야가 취약하다는 측면에서 중소기업의 기술경쟁력을 향상시킬 수 있는 근본적인 설계기술 및 표시, 판매, 설치, 서비스, 폐기의 전 단계에 걸친 제품안전 확보 활동과 분쟁 발생 초기의 대응활동에 대한 사전 준비 및 이해 당사자간의 책임분담, 분쟁처리에 필요한 재정적인 준비가 우선 요구되고 있다. 이러한 중소기업이 적정한 수준의 대응체계를 구축하과 유지하기 위한 대응력 제고 활동을 네 가지 측면에서 요약해 보면, 기업은 법률적인 측면, 기술적인 측면, 시스템적인 측면과 기업의 경영자원적인 측면에 대한 재검토와 보완해야할 요소의 식별, 달성 가능한 목표의 설정, 목표 달성을 위한 계획의 수립 및 실시, 성과의 분석을 통하여 지속적으로 기업의 활동 및 제품으로 인한 위험발생을 최소화하여하며 이러한 활동은 지속적이고 반복적인 활동의 수행이 요구된다. 이러한 네 가지 측면에 대한 검토와 기업의 활동 및 제품으로 인해 위험을 초래할 수 있는 위해요인을 식별하고 식별된 위해요인을 제거하거나 허용 가능한 수준으로의 관리, 제품안전을 위한 목표의 수립과 활동성과의 평가 등의 일련의 활동을 통하여 자사의 제품안전 수준을 향상함과 동시에 제조물로 인한 피해발생을 최소화함으로서 사용자의 안전을 보장하는 지속적인 활동을 수행하여야 한다. 아울러 이러한 대응활동은 기업 내부의 지속적인 제품안전 활동의 요구와 더불어 제품안전에 영향을 미치는 공급자를 포함한 외부 이해관계자의 관리와 사용자에 대한 커뮤니케이션 체제의 구축을 통하여 제품안전과 연관된 이 세 주체가 제품안전 확보와 사고 예방을 위한 유기적인 체제의 구축을 요구된다고 할 수 있다. 본 연구는 제조물책임에 대응하기 위한 제품안전경영체제 내에서의 활동 만을 서술하였으며, 기존 경영체제와의 통합에 대한 부분에 대해서는 추가적인 연구가 필요하다.|In relation to the activities of small and medium sized companies, which are playing important role in domestic industry, to effectively cope with product liability(PL) in their pursuing their administrative activities, this dissertation tries to look into the current priorities and problems that they need to tackle to grow into companies capable of responding effectively to PL at a certain level, and recommends the measure to enhance their ability to cope with the risk of product liability at a reasonal level. Amid the change in the level of demand for product safety in the market and legal environment, professional activities to secure strengthened product safety are being required. But small and medium sized companies can pursue those activities only in a limited way because they face difficulty in securing administrational resources, such as, professional workforce, time and cost. And considering that small and medium sized companies do not have a strong product safety, which is the one of the most essential activities to respond to the product liability, primarily they need to secure product safety in the entire stages including the indication, selling, installation, service, disposal, as well as the fundamental design technique, to improve their technical competitiveness and they also need to make preparation to respond to possible conflicts at the beginning stage, share the responsibility among parties of conflicting interest and make financial preparation to settle the conflict. To sum up the 4 aspects of activities to improve the ability of small and medium sized companies to establish and maintain a coping system, companies are required to review matters related to law, technology, system and administrational resources, identify the factors that need to be complemented, set the feasible goal, set up and implement plan to achieve the goal, and continue to minimize possible risk from corporate activities and product, and carry out those activities on a constant and repeated basis. They must continue to pursue those activities to ensure the safety of users by improving the product safety of their own companies and minimize the damage from products at the same time, which is possible by pursuing activities like identifying the risk factors that may cause possible danger from activities and product of companies, getting rid of the identified risk factors or managing them at a tolerable level, setting up the goal of product safety and evaluating the performance. And it can be said that they are required to realize organic system to prevent possible accidents by managing external parties of interest, including the supplier who affect the product safety, and the realization of communication system for users, as well as the internal activities of companies to ensure product safety on a constant basis, and to ensure that those suppliers, users and external parties of interest can secure the product safety. In this study, we described only the activities within the product safety control system to cope with product liability, and additional studies are required to deal with the integration with the current administrative system.
