마약류 범죄의 실태 분석과 대응방안에 관한 연구

Abstract

우리나라는 미국, 일본 등 외국에 비하여 상대적으로 마약안전지대로 평가받고 있으며,국제마약통제위원회(INCB)에서도 '마약단속을 성공적으로 잘하는 나라'로 평가받아왔다. 그러나 IMF 이후 사회적 불안으로 최근 신종마약류 밀반입이 급증하고 학생과 주부를 포함한 마약사범이 증가 추세에 있으며, 2001년 대검찰청에 마약부를 신설하고, 2002년 경찰청에 마약수사과를 신설하여 마약류범죄 수사역량을 강화하고 있으나 마약사범은 근절되지 않고 있다. 최근 마약투약사범에 한하여 처벌보다는 치료에 중점을 두어야한다는 연구가 상당수에 이르고 있지만 실무에는 거의 반영되지 않는 한계를 가지고 있다. 특히 정부에서는 '마약류 근절 종합대책'을 발표하고 단순투약자나 의존자에 대해서는 처벌위주의 단속방식을 지양하고, 치료보호를 조건으로 하는 기소유예나 집행유예 제도를 적극 도입할 것을 검토하고 있으나 현행 '마약류중독자치료보호규정'은 치료완료 후 검사 및 상담을 권고사항으로 규정하고 있어 개선할 필요성이 있다. 마약류 사범중 재범자가 84%에 이르고 있는 것으로 보아 예방 및 홍보업무의 양적·질적 확대와 함께 현재 교육인적자원부와 청소년보호위원회 및 보건복지부에서 시행하고있는 학생들을 대상으로 하는 예방교육의 통합과 전문화가 요구된다. 현재일선 학교에서 시행하고 있는 예방교육은 약물오·남용과 관련하여 술·담배에 국한되U 있는 실정이며, 이마저도 형식상 교육에 그치고 있다. 마약류사범의 수사는 경찰, 검찰, 세관, 국정원, 식품의약품안전청에서 담당하고 있어대형화 국제화의 유형을 띠는 마약거래조직에 신속하게 대응하지 못하고 있다. 장기간의 기획수사와 정보의 공유에 있어서도 각 수사기관의 공과의 다툼이 생길 경우 각 기관간 공조를 기대하기 힘들고 수사기관의 분산화는 예산과 인력의 낭비를 초래하고 있다. 이러한 문제점을 해결하기위하여 마약범죄 수사 전담체제(Task Force)의 설치 운영과 수사요원에 대한 전문화 교육의 실시로 마약류 수사업무의 질적인 향상을 꾀하여야 할 것이다. 전국적인 조직과 많은 인력을 가지고 있는 경찰에 마약수사를 포함한 범죄수사 전반의 권한을 부여하는 방안에 대한 강구가 있어야 할 것이다. 범행동기별 유형을 살펴보면 유혹과 호기심에 의한 경우가 전체의 16% 정도를 차지하고 있으며, 2003년 마약사범중 주부와 학생이 96명과 34명, 의사가 55명에 이르고 교수 및 종교가, 공무원이 다소 포함되어 있는 것으로 보아 우리 사회 전 계층에 확산되고 있음을 간접적으로 이해할 수 있다. 마약류 범죄의 특성상 암수범죄가 많은 점을 감안하면 우리사회는 이미 심각한상황에 처하여 있다고 할 수 있다. 이에 본 연구는 우리사회의 마약류범죄의 현황을 살펴봄으로써 마약류범죄에 대처하는올바른 방안을 강구하는데 하나의 시사점을 얻고자 한 것이다.|Korea has been reputed relatively as drug-safe country in comparison with the United States, Japan and other countries. INCB has also appreciated Korea as 'a country checking narcotics successfully'. However, due to the social unrest since the IMF bailout program, smuggling of new drugs has increased rapidly, while drug criminals including students and housewives tend to increase recently. Thus, Supreme Prosecutors' Office established Dept., of Narcotics in 2001, followed by National Police Agency who established Division of Narcotic Crime Investigation in 2002 to reinforce the investigation capacity against drug-related crimes, but these crimes have not yet been rooted out. Recently, many researchers argue that drug addicts should be treated rather than punished, but such arguments are little heard in investigation or prosecution practices. In particular, the government published 'a comprehensive counter-measure to root out drug uses' and thereby, considers introducing a prosecution or execution suspension system for simple drug users rather than arrest and punish them. However, since the current 'Drug Addicts Treatment and Protection Code' recommends checking and counselling after a complete treatment, the legal system need to be rearranged. On the other hand, since second and more offenders account for 84% of drug-related criminals, it is required of relevant authorities to expand their prevention and publicity activities in terms of both quantity and quality, while integrating and professionalizing the prevention education programs for students operated by Ministry of Education & Human Resources, Youth Protection Committee and Ministry of Health and Welfare. The prevention programs operated by schools are focused only on drink and smoking as drug misuse/abuse, and even such programs are not substantial. On the other hand, since drug-related crimes are investigated into by multiple authorities induding police, prosecutors, customs office, National Intelligence Service and Food & Drug Administration, larger-scale and international drug deals are not effectively checked. Even in a long-term planned investigation and information sharing, inter-organizational cooperation may not be feasible if they conflict with each other for merits, much less saving of budget and manpower. In order to solve such problems, it is deemed necessary to establish a 'drug crime investigation task force', educate the investigators to be more professional and thereby, enhance the capacity of drug crime investigation. In particular, it is also deemed necessary to consider authorizing the police with a nation-wide network of huge forces to investigate into crimes including drug crimes.
