Abstract

One of the key changes is the expansion of Entity Dynamics, which has a wider range of convergence and innovation centered on technology and ideas, and a shorter cycle of substitution. And at the center is the convergence of technologies. As a result, the destruction of existing domains and boundaries, such as competition, cooperation, and fusion between entities that are irrelevant, is taking place. Therefore, in the era of technology convergence with other industrial fields emerged from the advent of the fourth industrial revolution, the company 's open innovation has become a necessity for survival rather than choice. So what technology should a company adopt to survive? What patents (technologies) should be bought, especially in the fourth industrial revolution? Is facing the issue of. In addition, the Korean Intellectual Property Office (KIPO) has selected seven core technologies in the field of the fourth industrial revolution and established a new classification system based on CPC classification to promote international standardization. The purpose of this study is to analyze the effect of patent index on patent sales by using CPC - based new patent classification system. The empirical analysis was conducted using the statistical tool SPSS 23.0 to identify the correlation between the major four-country family, the additional family, the number of agents, the number of priorities, the patent status, The results of the study are summarized as follows. First, the major 4 countries have a significant positive effect on patent sales. This is because, if patents filed in the four major countries of the US, Japan, Korea, and Europe, they occupy an important position in the market This implies that it can have a positive effect on the success of a patent because it can be regarded as having market dominance over the country. Second, the additional family has a significant positive effect on patent sales, which can be regarded as an increase in the market power of patents filed in countries other than four major countries, And that this may have a positive impact. Third, the number of agents showed a positive (+) effect on the sale of patents. In the case of designating an agent at the time of filing a patent, the more the number of agents, the more the additional cost. As the burden increases, many agents will be appointed in the case of technologies that are important to the position of the applicant. As a result, the probability that the completeness and quality level of the specification will be higher in proportion to the number of agents is increased. This suggests that the more positive the patent transaction, the more positive the effect will be. Fourth, the number of priorities showed a significant positive effect on patent sales. This means that the more priority the patent application is given, the less the economic burden can be applied by applying for the application on the basis of multiple prior applications, Since patent applications can be retracted at the time of filing as the first filing date, the number of patent applications with priority can be increased. As a result, patent applications with a high number of priorities are positively affected. Fifth, the patent status has a significant positive effect on patent sales. In the case of a patent that promotes early disclosure or early registration in terms of the law, it is necessary to promptly commercialize the patent from the applicant, And the protection of business rights, which are important technology patents that can be seen as a patent application can have a positive impact on the implication of the implication. Finally, the number of inventors showed no significant effect on patent sales. In general, as the number of inventors is higher in terms of the technical aspect of patents, the accuracy and fidelity of the inventions are high and the technological feasibility is high. The US registered patents and the Korean registered patents of the 3D printing technology, which is a field of industrial revolution, suggest that the number of inventors has little effect on patent sales. Based on these results, it can be concluded that when introducing external technologies from the perspective of a company in the era of the fourth industrial revolution, the patent indexes used in this study, namely the patent bibliographic information provided in the patent database, It is expected that the number of agents, number of priorities, and patent status (early disclosure or early registration) will be readily available to anyone as a tool to select candidates for patent sales.

【Key words】 Patent marketing, patent index, 4th industrial revolution, 3D printing, major 4 countries family, additional family, number of agents, priority number, patent status, early disclosure, early registration|최근 4차 산업혁명이 도래함에 따라 많은 변화가 일어나고 있는데 그러한 핵심 변화 중 하나는 ‘기술과 아이디어 중심으로 융합과 혁신의 폭이 커지고, 대체의 주기는 짧아지는 Entity Dynamics의 확대’라고 할 수 있다. 그리고 그 중심에는 기술의 융합이 자리하고 있다. 그러한 결과로 무관했던 Entity 간 경쟁-협력-융합 등 기존 영역과 경계의 파괴가 급진전되고 있는 현상이 일어나고 있다. 따라서 4차 산업혁명의 도래로 대두된 타 산업분야와의 기술융합의 시대에서 기업의 Open innovation은 선택이 아닌 생존을 위한 필수사항으로 부각되고 있다. 그렇다면 기업은 생존을 위해서 어떤 기술을 도입해야 하는가? 특히 4차 산업혁명 분야에 있어서 어떤 특허(기술)를 매입해야 하는가? 라는 화두에 직면해 있다. 또한 한국 특허청은 4차 산업혁명 시대를 맞이하여 4차 산업혁명 분야에 있어서 핵심 7대 기술을 선정하고 이에 대해 CPC 분류를 활용한 신특허분류체계를 수립하여 국제표준화를 추진하고 있다.

본 연구는 CPC 기반 신특허분류체계를 활용하여 특허지표가 특허매매에 미치는 영향을 분석함으로써 4차 산업혁명 분야에서 기업이 매입 대상으로 하는 기술을 선정하는 도구로서의 활용 방안을 도출하고자, 특허지표 중에서 주요4국 패밀리, 추가 패밀리, 대리인수, 우선권수, 특허상태, 발명자수 등을 독립변수로 선정하고 종속변수인 특허매매와의 상관관계를 파악하고자 통계 툴 SPSS 23.0을 사용하여 실증분석을 수행하였다.

연구결과를 요약하면 다음과 같다.

첫째, 주요4개국 패밀리는 특허매매에 유의미한 정(+)의 영향을 미치는 것으로 나타났고, 이는 주요 국가인 미국, 일본, 한국, 유럽의 4개국에 출원한 특허일 경우 그만큼 시장에서 중요한 위치를 차지하는 국가에 대한 시장지배력을 가졌다고 볼 수 있어서 특허매매 성사에 긍정적인 영향을 줄 수 있음을 의미한다.

둘째, 추가 패밀리는 특허매매에 유의미한 정(+)의 영향을 미치는 것으로 나타났고, 이는 주요 국가 4개국 이외의 국가에 출원한 특허일 경우 그 수만큼 시장지배력을 확대한 것으로 볼 수 있어서 특허매매 성사에 긍정적인 영향을 줄 수 있다는 점을 시사한다.

셋째, 대리인수는 특허매매에 유의미한 정(+)의 영향을 미치는 것으로 나타났고, 이는 특허 출원시 대리인을 지정할 경우 특히 대리인수가 많아질수록 그만큼 더 비용을 추가적으로 부담하게 되고, 대리인의 수가 증가할수록 경제적 부담이 커지므로 출원인 입장에 중요한 기술의 경우에 다수의 대리인을 선임할 것이며, 이에 따라 명세서 작성의 완성도, 질적 수준 등도 대리인의 수에 비례해서 더 높아질 확률이 커짐을 의미할 수 있으므로 대리인수가 많은 특허일수록 특허매매 성사에 긍정적인 영향을 줄 수 있다는 시사점을 준다.

넷째, 우선권수는 특허매매에 유의미한 정(+)의 영향을 미치는 것으로 나타났고, 이는 특허 출원시 우선권 지정이 많을수록 다수의 선출원을 기초로 후출원함으로써 경제적 부담을 줄이고, 신속한 권리화를 진행할 수 있으며, 출원시점을 최우선 출원일로 소급할 수 있기 때문에 등록가능성도 높일 수 있어서 다수의 우선권 주장 출원은 출원인 입장에서 중요한 기술에 대한 출원 관리 기법을 의미함으로 우선권수가 많은 특허일수록 특허매매 성사에 긍정적인 영향을 줄 수 있다 점을 의미한다.

다섯째, 특허상태는 특허매매에 유의미한 정(+)의 영향을 미치는 것으로 나타났고, 이는 법적 측면에서 조기공개 또는 조기등록을 추진한 특허일 경우, 출원인 입장에서 신속한 사업화가 필요하거나 신속한 권리화를 통해 기술의 보호 및 사업권 방어 등이 필요한 중요한 기술의 특허 출원으로 볼 수 있어서 특허매매 성사에 긍정적인 영향을 줄 수 있다는 점을 시사한다.

마지막 여섯째, 발명자수는 특허매매에 유의하지 않은 결과를 보였고, 이는 통상의 경우 특허의 기술적 측면에서 발명자의 수가 많을수록 발명의 정확성과 충실성이 높아 기술성이 높은 것으로 평가되는데, 본 연구의 분석대상인 4차 산업혁명 분야인 3D 프린팅 기술의 미국등록특허와 한국등록특허에서는 발명자수가 특허매매에 미치는 영향이 미미하다는 것을 시사한다.

이러한 결과를 기반으로 4차 산업혁명 시대에 기업 입장에서 외부의 기술을 도입할 경우, 본 연구에서 사용된 특허지표들 다시 말해, 특허 DB에서 제공하는 특허 서지정보 중에서 주요 4개국 패밀리, 추가 패밀리, 대리인수, 우선권수, 특허상태(조기공개 또는 조기등록)를 특허매매 대상 후보군 선정에 우선적인 도구로서 누구나 쉽게 사용할 수 있을 것으로 기대된다.
