우리나라 아동학대의 실태와 개선방안에 관한 연구

Abstract

사회의 원초적인 단위이며 인류문화의 가장 소중한 유산인 가정에서 긴장이 내재하게 될 때 가정을 기반으로 하여 이루어진 사회나 국가의 건강을 기대할 수 없을 것이다. 아동학대는 부모를 포함한 성인들이 아동의 권리를 박탈하는 가장 흔한 경우이다. 동시에 매우 중요한 문제이다. 왜냐하면 피해자인 아동이 자기방어의 능력이 없고, 또한 가해자가 아동이 믿고 의존하는 보호자나 성인이라는 점에서 아동의 정상적인 사회적, 지적, 정서적 발달에 부정적인 영향을 미치기 때문이다. 특히 아동들에게 가해진 모든 형태의 학대는 어린이들에게 신체적 손상 뿐만 아니라, 일생을 통해서 치료하기 힘든 그들의 자존심과 독립심을 파괴하는 마음의 깊은 상처로 남을 수도 있다. 아동학대는 가정과, 사회 또는 지역의 특성에 따라 다양한 형태의 양상을 보임으로 올바른 실태 분석을 위해 신체적 학대, 정서적 학대, 성적 학대, 방임, 유기 등으로 구분하여 각 관련기관의 기존 조사 결과, 각종 보고서, 세미나 자료, 전문 학술지 등을 참고로 실태를 분석 하였다. 아동학대의 결과로는 정신지체와 언어장애가 발생할 수 있으며, 이외에도 발달지연과 대인관계에서의 어려움, 가정이나 학교에서의 공격적이고 파괴적인 행동유발 등 심리적, 정서적 후유증을 갖는다. 그리고 아동학대는 청소년기의 탈선 및 범죄 등의 각종 사회문제로 연계될 가능성이 높다. 아동학대의 문제점과 개선방안을 위한 대책을 살펴보면 다음과 같다. 첫째, 우리나라의 특성에 맞는 아동학대 개념의 정립과 학대 유형별 개념의 정립이 있어야 한다. 둘째, 법․제도적 측면으로 신고제도의 강화와 가해자에 대한 처벌기준의 강화를 들 수 있다. 셋째, 사회․문화적 측면으로 아동학대를 유발하는 요인의 제거와 아동보호시설의 확충을 들 수 있다. 넷째, 행정․서비스 측면으로 피해아동과 부모에 대한 예방사업 추진과 사후적 보호체계가 중심이 되어 보호체계가 형성되어야 할 것이다.

아동학대 예방을 위해서는 국가적 차원의 재원 확보와 전 국민의 아동학대에 대한 인식의 변화가 있어야 할 것이다. 이를 통해 우리나라의 아동학대에 대한 아동학대의 문제를 해결하는 것은 아동 개인의 문제 뿐 아니라 우리 사회의 미래를 위한 것이기 때문이다.| If there's tension in the family which is the basic unit of society and the most valuable inheritance of mankind. it won't be to expect the healthy society or nation which are created on the basis of a family. The child abuse is the common case of deprivation of the children' right by adult including parents, and it is very important because it causes negative effect on social, intellectual and emotional development of children in the respect of that the victim, who are children, can't protect themselves and perpetrators are guardians or adults whom children trust and rely on. Especially, every type of child abuse may remain in their mind as a bruise which could destroy their self-respect and spirit of independence and hard to cure in their lifetime. Because Child abuse appears to be formed variously as the family, society and regional characteristic, I classified the type of child abuse into physical abuse, metal abuse, sexual abuse, neglecting, abandonment etc for the right analysis and referred to existing research result, all sorts of reports, seminal materials, academic journals etc. Child abuse may cause a mental retardation and a speech disorder as well as a psychological and mental aftereffect such as a developmental disability, problems on personal relations, and an aggressive and destructive behavior. And also, there's high possibility of connecting into various social problems such as deviation and crime in the adolescence period. The problem and improvement plan of child abuse is shown as below. First, the concept and the type of child abuse have to be established fit for the characteristics of South Korea. Second, the reporting system and the standard of punishment have to be strengthened in the aspects of law and system. Third, the cause of child abuse have to be eliminated and a sheltered housing has to be expanded in social and cultural aspects. Forth, the prevention project for child abuse victims and parents has to be promoted and the posteriori protection system has to be created in administrative and service aspects. To protect from child abuse, the financial resources at the national level has to be secured and the changing public attitude on abuse is necessary because solving the problem of child abuse is for a matter of individual as well as for the future of our society.
