Abstract

Defects on apartmet housing are caused by various reasons such as negligent planning, improper construction or inadequate usage. Moreover, it is hard to establish a perfect regulatory method that can prevent any defects of apartment housing. This study will examine previous anaysis on defects of apartment housing and other examples of the apartment's repair system from other countries and investigated judicial decisions made from main law suits among residents, construction company, and guarantee. Also, it presents alternatives that can improve current operating system for a variety of measures to improve the apartment's Defects was provided. Thus, considering the apartment's repair system which ensures 10 years of guarantee, having an official that assure apartment repair and financial compensation would be the best alternative. Since there is no guarantee which assures defects occuring after 10 years of the construction, we can strengthen the weaknesses of current the apartment's repair system by providing various product warranty through guarantee institutions. Moreover, guarantee institutions. will help control and prevent defect of apartment housing volunteerly and improve housing quality through pre-inspection and differential rate of guarantee fee. It also suggests that prevention of defect of apartment housing with having solid registration of construction companies and monitoring system is crucial. Therefore, to revitalize proper fuctions of Dispute Mediation Committee regulated by Housing laws is key to solve this problem. In Korea, apartments are constructed rapidly in large scale with such a short period of time and apartment housing becomes our main residential life style. Defects of apartment housing is not a problem to one resident, but to all nation, therefore, we need an organized and comprehensive plan that solves these defect problems. For future studies, we need to gather and analyze various information on defects of apartment housing problem which can lead to consolidated construction standards and examine new product warranty through guarantee institutions to relieve damages of apartment residents.
