사전정보공개제도의 운영 및 서비스에 대한 개선 방안 연구

Abstract

본 연구는 중앙행정기관의 사전정보공개제도 운영 및 서비스 현황을 조사·분석한 후 개선 방안을 제시하고자 하였다. 이를 위하여 우선 문헌연구를 통하여 사전정보공개제도의 도입 및 변천과정을 살펴보았다. 또한 40개 중앙행정기관의 정보공개관련 규정과 홈페이지를 통하여 사전정보공개제도 운영 현황을 분석하였다. 그리고 40개 중앙행정기관의 사전정보공개 업무 담당자를 대상으로 제도 운영 및 서비스에 대한 설문조사를 실시하였다. 설문회수율은 62.5%(25명)였다. 40개 기관을 대상으로 한 현황조사는 첫째, 기관 정보공개운영규정의 공개정보 범위선정 기준, 둘째, 홈페이지에 공개된 사전정보공개 목록의 선정 기준, 셋째, 홈페이지에서 사전정보공개와 관련된 명칭의 사용과 원문정보로의 링크연결 상황, 검색 제공에 대해서 살펴보았다. 조사결과 각 기관은 공개대상 정보의 범위선정 기준과 공표목록의 선정 기준을 「정보공개법」, 동법 시행령, 「정보공개지침」, 업무 및 부서별 등 다양하게 사용하고 있었다. 홈페이지에서 사용하고 있는 사전정보공개제도에 대한 명칭 또한 다양하였으며, 대부분 링크를 연결하여 정보를 제공하고 있으나, 그 연결의 오류도 일부 나타났다. 설문조사는 사전정보공개 제도 및 업무에 관한 부분, 사전정보공개 운영에 관한 부분, 사전정보공개 서비스에 관한 부분으로 이루어졌다. 조사결과를 기반으로 도출된 문제점을 요약하면 다음과 같다. 첫째, 사전정보공개 업무 및 제도 측면에서는 현재 사전정보공개 담당자의 대다수는 기록연구직이었지만 이들 중 대다수는 사전정보공개 업무가 기록연구직의 업무는 아니라고 생각하고 있었다. 또한 사전정보공개제도에 대한 이해도와 관심도, 필요성에 대한 인식은 전반적으로 높게 나타났지만 사전정보공개가 잘 이루어지고 있다는 응답은 상대적으로 낮게 나타났다. 또한 사전에 공개하는 정보의 범위를 선정하는 방법이 기관마다 다르게 나타났다. 사전공개 대상이 되는 정보를 선정하는 기준은 「정보공개법 시행령」 제4조 제1항이 되어야 하지만 이를 기준으로 하는 기관은 매우 적었다. 특히『정보공개운영매뉴얼』에는 ‘공공기관의 장이 정하는 정보’의 선정 기준을 정보공개청구 빈도가 높은 정보를 선정하도록 권장하고 있지만 이렇게 하고 있다는 응답자는 1명(4%)에 불과하였다. 또한 ‘정보공개모니터단’을 1년에 최소 2회 실시하도록 권장하고 있지만, 9명(36%)만이 이를 준수하는 것으로 나타났다. 둘째, 사전정보공개의 서비스 측면에서는 이용자가 정보공개청구 전 사전정보공개 서비스를 이용한다는 응답자가 6명(24%)에 불과하였다. 또한 홈페이지에서 검색 서비스가 이루어져야 한다는 응답자가 많았다. 이러한 문제점을 개선하기 위한 방안을 다음과 같이 제안하였다. 첫째, 정보공개 업무 전담 부서를 신설하여 사전정보공개 업무를 주관하고 기록연구직은 현용기록의 서비스와 관련된 업무를 지원해야 한다. 둘째, 사전정보공개의 운영 절차를 각 기관의 정보공개 관련 규정에 명시하여 업무가 일관성 있게 이루어지도록 해야 한다. 구체적인 업무의 과정 및 업무 분담에 대해서 명시하고 이를 기반으로 하여 사전정보공개가 운영되어야 한다. 셋째, 이용자가 관심있어 하는 공개정보를 대상으로 홍보가 이루어져야 한다. 그리고 사전정보공개목록과 정보공개목록을 통합하고, 이용자가 공개정보로 쉽게 접근할 수 있도록 각 기관 홈페이지와 정보공개시스템에서 검색 서비스가 이루어져야 한다.

For those purposes, the investigator conducted literature study to trace the introduction and changing process of the system and analyzed its current operations based on the information disclosure-related regulations and homepages of 40 central administrative agencies. A survey was carried out on the operation and service of the system with the staffs in charge of proactive disclosure at 40 central administrative agencies. The questionnaire return rate was 62.5%(25 staffs). For the current state at the 40 agencies, the study first examined the criteria to set the disclosure scope in the operational regulations of information disclosure at each agency. Second, the study examined the criteria of proactive disclosure lists at the homepages of the agencies. Third, the study examined the usage of designations related to the homepage service, provision of link connections, and provision of research results and found that each agency put the criteria of scope setting and public announcement lists to various uses including Freedom of Information Act, its enforcement ordinances, Information Disclosure Guidelines, jobs and departments. The designations of the proactive disclosure varied among the homepages of those agencies. Most of them provided a link for information, but some of them were accompanied by connection errors. The questionnaire items concerned the proactive disclosure and its affairs, operation, and service. Based on the findings, the study summarized the identified problems as follows: first, as for the jobs and institution of proactive disclosure, most of the staffs currently in charge of proactive disclosure belonged to the category of records research, and a majority of them thought that proactive disclosure was not in the job description of records researcher. The subjects showed an overall high perception level of understanding, interest and need for the proactive disclosure, but the percentage of those who believed that proactive disclosure was going well was relatively low. The ways the scope of information to be made public in advance were set varied among the agencies. Article 4, Clause 1 of Enforcement Ordinance of Freedom of Information Act prescribes a set of criteria to choose the information to be made public in advance, but very few agencies adopted those criteria. "Operational Manual for Information Disclosure" particularly recommends that a public agency should choose the information of high frequency for information disclosure application according to the selection criteria of "information decided by the head of agency," but only one respondent(4%) mentioned the criterion. While it is recommended that a "monitoring group of information disclosure" should be formed at least twice per year, only nine respondents(36%) said that their agencies followed the recommendation. Secondly, as for the service of proactive disclosure, only six respondents(24%) believed that users made use of proactive disclosure before submitting an information disclosure application. Many respondents said that homepages should offer search service. The study proposed the following measures to help to resolve those issues: First, a new department devoted to information disclosure jobs should be set up to supervise the jobs of proactive disclosure and allow records researchers to support the affairs related to the current records service. Secondly, each agency should clearly include the operational procedure of proactive disclosure in its information disclosure regulations for coherent job performance. They should also clearly state the specific job processes and division of works and run the proactive disclosure based on them. Finally, promotions should be centered around the types of open information in which users take interest. It is also needed to integrate the proactive disclosure list with the information disclosure lists and offer search service at the homepage and information disclosure service of each agency to facilitate user access to open information.
