빅데이터 시대, 개인정보보호와 기업의 손해배상책임

Abstract

개인정보의 비식별화를 통해 빅데이터의 산업 활성화를 위해 소위 ‘빅데이터 3법‘이 발의되었다. 하지만 재식별화 문제 등 정보주체의 권리와 정보처리자의 책임성을 강화하는 내용은 미약하다. 대량으로 개인정보가 유출되는 사고는 빈빈히 발생하고 있는 현실이다. 개인정보 유출사고가 발생한 기업은 과징금, 과태료 부과, 경영진의 불구속 입건과 같은 형사적 책임뿐만 아니라, 개인정보 유출로 인한 피해자에게 민사상 손해배상 책임, 기업의 이미지 하락과 고객 신뢰성 하락, 매출 감소, 주식 하락 등 다양한 손실이 발생하게 된다. 여기에서는 개인정보 유출 사고들과 관련된 손해배상책임에 대한 법적 판결 사례들을 살펴보고 기업들의 정보보호현황을 유추해봄으로써 기업들이 개인정보 유출사고에 대한 책임감을 고취시키기 위해 법적인 손해배상의 향후 방향에 대해 살펴보고자 한다.|The bill, so-called "Three Big-Data Bills", was debate that companies are using personal information by De-identification of personal information in order to activate the big-data market in 2018. this bills are weak for the information owner's rights and the information handler's responsibilities(etc. Re-identification). The accidents in which a large amount of personal information is leaked are currently occurring in korea. In particular, the damage caused by personal information spills at credit-card companies and financial companies that hold large amounts of personal information is a major loss nationally. In the event of a personal information breach accident, the company will be various losses that not only criminal charges (such as penalties, fines, and executive restraints) but also victims of personal compensation for damages to leakage of personal information. In this section, we will look at legal judgments on liability for damages related to personal information leakage and infer the information protection status of companies to induce companies to take responsibility for personal information leakage.
