- Our society in 21th century has the task to actively confront with a new hcange in all fields. The real estate field is also going through a change in the whole paradigm of real estate industry like the existing trading tradition, the management form and so forth.
The real estate industry which focuses on land and building is expanding its activity range as a life industry by confronting with the living life of individuals and the various demand of other industries, and this change makes real estate service industry more important with the progress of the advent of information-oriented society according to the development of information communication like the industry structure adjustment, internet and so forth and with the quality improvement of the standard of living..
As the real estate information distribution of our nation's real estate service industry is limited to the market and the local form and the information distribution is closed and has developed on the state that the systemic condition is insufficient owing to the traditional idea, so its image and public confidence are weak and it didn't supply the service satisfactory to consumers owing to the pettiness and the non-professionality .
Likewise, the service now supplied is limited to some rather than is one-stop service including the whole trade due to the structural limitation with which the real estate service industry confronts, so that the persons of the transaction additionally need the professional service of various fields like right analysis followed after the transaction, escrow, insurance, and so forth. This current system requires lots of time and efforts in trading real estate, and it is difficult to judge totally about the transaction itself.
The introduction of the total real estate service industry should be started as a countermeasure to reinforce the competitive power according to the opening of market by supplying a good quality service to consumers, promoting an advancement of real estate service industry, and raising the efficiency of real estate service industry.
The problems of our nation's real estate service industry structure are as follows. Firstly, our nation's real estate service industry structure has its industrial framework oriented not to the consumers who are the customs of the service but to the suppliers who supply the service, so it has the premodern form which does not differentiate the qualification and the industry type.
This industrial structure can't confront flexibly with a new service like the firm merger, M & A, publishing of assets backed securities, real estate investment trust & real estate market research & real estate information offering and so forth.
Secondly, the real estate related service are very various, and they form a circulation course by connecting each other. By the way, as the related industries in the real estate industry structure of our nation are separated each other, the demand and the supply of the service are not connected well.
They have much inconveniency, expense and an insufficient trait which can't satisfy the time-consuming and gradually raised service demand of consumers.
Thirdly, the real estate service industry hardly has the economies of scale and the economies of scope for there are related industries as many as the large scope of real estate service industry and for the most industries are small.
The reason is not only the habitual practice recognizing the service industry as residual business rather than recognizing it as the independent industry, but also the most big reason is fundamentally the allowing of exclusive and monopolistic service supply to the qualified.
Namely, the individual professional law is systematized to protect the qualified and its business rather than to protect consumers, so that the capital and the administration, the professional knowledge and the administration are not separated.
The real estate service needs to be synthesized in order to solve these problems and supply the service of good quality.
The strategy to introduce real estate service industry is as follows.
Firstly, the synthesized real estate industry should be newly established.
Though the real estate service is very unclear and has a high risk because the industries for real estate service are all dispersed and because the real estate service which is connected each other and circulates continuously can't supply the related information totally and systematically, the systematic compensation device for this is insufficient.
The total real estate service industry should be newly established in standard industry classification system so as to supply the real estate service by synthesizing the related industries dispersed by the professional law of each industry type or by qualification in order to supply the real estate service of good quality by raising these problems.
Namely, we , giving a life to the economies of scale and scope by systematizing the industry which can totally supply the service at one time, should generate a value added by raising the quality of the service, and should promote the conveniency and economic profit of service consumers.
Secondly, it is necessary to specialize and make larger through dividing of capital and administration and the professional qualification.
The total real estate service corporation should be freely established with a registration requirement employing the professionals of the related field like a number of appraisal experts, a licensed real estate agent and so forth without the professional qualification in order to induce larger and specialized total real estate service industry to have an international competitive power. And, it is preferable to induce it to supply the necessary service through the autonomous business cooperation with the type of industry needing a horizontal and vertical business cooperation like a lawyer, a licensed tax accountant, a judical scrivener and so forth.
It is necessary to make it obligatory to subscribe the guarantee insurance of sufficient scale for the loss and damage generating during the service supplying procedure and the dissention of the confronting parties in order to make the total real estate service industry to provide a good quality service to consumers and to have the competitive power.
Thirdly, We should systematically collect, analyze and manage the real estate information.
We should always maintain and manage the real estate development information like the related law, the development plan, market information and so forth in order to supply totally the real estate service. Because the exactness and the clearness can be confirmed and the risk can be minimized by supplying the related information totally and systematically.
The funds for investment in forming a portfolio may recognize the real estate market as not the compensative market of the finance market or the capital market but the substitute market.
Therefore, the total real estate service industry collect and analyze the information not only on the real estate but also on the movement of the funds market, and it is necessary to construct the system combining and managing the stock market, the foreign exchange market, the bond market, the finance market and the real estate information market.
The fourth strategy is the enactment of the total real estate service industry law.
The type of industries related to the real estate service are almost running on the basis of the individual law.
We can't follow the change of the real estate market, the capital market and the finance market changing rapidly after foreign exchange crisis with the existing individual law.
Therefore, the total real estate law should be enacted so that the real estate service industry grows and becomes professional as the trustable industry supplying the good quality real estate service to consumers .
We should make the real estate service industry to function the advanced real estate service by totally regulating the establishment and establishment requirement of the total real estate service industry accepting the service not acceptable to the existing law system, the becoming larger and professional of the total real estate service industry through the dividing of capital and administration and the professional qualification, the supporting plan to induce the constructing of related information system, the achievement of one-stop service from the agent fee autonomy for protecting consumers, the exclusive agent contracting, consulting to tax payment, the real estate trading fulfilling assurance and the real estate right insurance business performance and so forth.
