痲藥類 事犯 搜査上 問題點과 그 改善方向에 關한 硏究

Abstract

한국은 최근 일본의 히로뽕사범의 병폐에 물들어 몇년간 잠복기를 거치다 1988년을 전후하여 사회적으로 표면화되었고 1992년 현재까지도 계속적으로 증가 추세를 보이고 있다. 이에 대처코져 수사기관은 혼신을 다하고 있으나 동종사범에 종사하는 수사관이 히로뽕의 약리적 작용 및 단속 법률인 향정신의약품 관리법에 대한 충분한 숙지는 물론 적발한 범죄 사실에 있어서도 형사소송법상 적법하게 운용하는데 많은 문제점이 도출되었다. 이렇게 제기된 문제점을 바탕으로 본 연구는 수사 행정 업무를 원활하게 전개시킬 수 있도록 그 개선 방향을 다각적으로 모색하는데 목적을 두었다. 제기된 문제점의 내용과 개선방안으로는 첫째, 히로뽕 사범의 경시 경향, 수사예산의 확보, 정보원의 활용상 한계점 및 밀수출입에 대한 연안 봉쇄의 곤란에 대한 수사실제상의 문제점에 대해 각각 올바른 방안을 제시했고 둘째, 수사 이론상의 문제점은 약물 임의 입증, 물증 없는 사건의 입증, 뇨검사, 함정수사, 사건의 입건에 대해 그 개선방안을 마련했다. 셋째, 히로뽕 사범 態樣별 수사 방법에 대한 문제점에 있어서는 제조사범 유통사범 소지사범 사용투약 사범에 대한 수사방법을 개선시켰다. 본 연구의 이론적 배경의 고찰은 기히 발표된 국내외 주요 문헌을 인용은 물론 현실적으로 일어나고 있는 자료를 활용하였고 수사방법의 문제점과 개선방안을 모색하는데 있어서는 부산지방에서 발생한 실제상황을 토대로 그동안 수사가 진행된 경과나 추이에 따라 수사 및 공판기록을 분석하는 기법을 활용했다. 이상과 같이 연구 분석한 내용에 의거 전수사관이 히로뽕 퇴치업무를 수행할 때에 심도 있게 활용되어야 함을 제언하고 또한 수사활동 이전에 충분한 예방과 홍보 활동으로 스스로 마약에 빠져 들어가지 않게끔 마약류를 거부하는 사회 풍토를 조성하는 국민정신을 강화시키는데도 앞장서야 됨을 주장했다.|In Korea, after some latent period, the number of philopone abuse cases, partly influenced by the drug-abuse spread in Japan, has rapidly increased from around 1988 up to the present. Admitting that investigation agencies concerned do their best in coping with such pathological phenomena, some fundamental problems have been pointed out, including investigators' innocence and inexperience of drug-abuse effect and legal regulations, and their poor operations of related regulations in practicality. The purpose of this study is to point out the problems mentioned above and thereby facilitate the investigation procedure. First, the measures to be taken are recommended respectively against the problems of general indifference to drug-abuse in the society, securing enough budget for investigation, intrinsic difficulty in deriving credible information from cooperative citizens, and practical difficulties in sea-blockade to prevent drug-trafficking. Secondly, some proposals are made to solve the theoretical problems involved in verification of drug-abuse cases, verification of cases without evidence, urine-test, entrapment, etc. Thirdly, improvements on investigation method have been made with respect to various types of cases, such as manufacturing, providing, holding and using of drugs. Methodologically, I have cited foreign as well as domestic related literature and, in particular, made use of investigation and trial procedure data of Pusan area in detecting the related problems and recommending solutions thereof. It is my sincere belief that this study can be of some help to all the investigators in taking counter-measures against philopone abuse spread. And it cannot be emphasised too much that the sound community spirit and effective public relations matter most in preventing the further spread of drug-abuse.
