경찰 수사권 독립에 관한 연구

Abstract

경찰은 국민의 자유와 권리를 보전하고, 사회질서의 유지 및 범죄를 예방할 책임이 있다. 현대사회에서 경찰은 국가 공행정의 가장 대표적인 조직이다. 따라서 민주국가에 있어 경찰력은 그 나라의 정치제도 내에서 합법적, 민주적, 효율적, 중립적, 독립적일것임을 요구한다. 본 연구의 목적은 경찰과 검찰에게 국가 형벌 집행권을 상호 유기적인 협력과 경쟁하에서 동등하게 분배하고, 현행 수사구조에 대한 문제점을 개선하여 경찰수사능력의 향상과 민주성을 높이는데 방안에 있다. 비록 경찰이 전체 형사사건의 97%를 처리한다 하더라도, 경찰은 아직도 검사의 지휘 및 명령을 받는 수사 보조자로 머물러 있다. 그러므로, 현행 검찰에게 독점되어 있는 수사권에 대하여 경찰에게 어느정도 적정하고 독립된 수사권을 부여할 것인가에 초점을 맞추었다. 수사구조 개선은 동등한 경찰과 검찰이 동등한 기관임을 말하는 것이다. 따라서 범죄수사에 있어서 경찰에게 독립된 수사권을 부여해야 한다. 그러기 위해서는,현행 수사구조의 문제점이 명확하게 고찰되어야 하고, 경찰 수사권 독립의 필요성에 대한 당위성이 필요하다. 검사는 수사부터 형사절차까지 모든 절차에 있어서 절대적인권한을 가지고 있다. 그러나, 경찰은 검사만큼의 권한이 없어, 경찰에게 적정한 범위내에서 수사권을 부여해야 한다. 만약 경찰이 독자적인 수사권을 가진다면, 인권보장에 도움이 되고, 증가하는 범죄수사를 신속하고 효율적으로 할 수 있으며, 경찰과 검찰의 상호 균형이 이루어지고, 형사절차와 수사의 과정에서 증거수집에 대한 비용절감을 이루어 낼 수 있으며, 경찰과 검찰의 이중수사로 인한 국민 불편과 불안감이 감소될 수 있다. 또한 검찰은 경찰에게수사권 분배를 통한 업무 부담의 감경과 고도의 법률적인 판단을 요구하는 범죄 수사에 대해 매진할 수 있게 될 것이다. 따라서 본 논문은, 제2장에서는 경찰 수사권독립의 필요성에 대한 논의를 살펴보았고,제3장에서는 선진국의 검찰과 경찰의 관계 및 수사구조 등에 대하여 고찰해 보았다. 제4장에서는 그간 수사권 독립에 대한 논의에 대해서 살펴보았고, 제5장에서는 경찰수사권독립을 위한 방안을 모색해 보았다. 제6장은 이제까지 알아본 지식들의 종합을 통하여 경찰수사권독립을 위해 필요한 모든 제반 문제들과 그 방안을 종합하며 한국경찰이 나아가야할 새로운 방안을 제시하며 결론을 내렸다.|The police is responsible for the protection of the nation's freedom and rights, the maintenance of social order, the prevention of crime and its due investigation. In the modem society, The police is the nation' representative organization of the public administration. Consequently, the police force in a democratic nation should be legitimate, democratic, efficient, neutral, and independent, within the political system of the nation. The object of this study is to divide the police and the prosecution with national punishment power exercise equally under the organic collaboration and competition and to raise the democracy and capability of police investigation effectively by improving problems of the current investigation structure. Even though the police arrests and manages about 97% of the whole crimes, they are still stay the assistant of the prosecutor under the commands and the control of the prosecutors. Therefore, this study aims to discuss on the independence of investigative authority of the police in order for investigative authority to be adequately distributed to each of them. Relation between the police and the prosecution in the new improved structure of investigation is equal administrative authorities. So, police is to have right of independent investigation at criminal investigation. Then the current situation and problem of the investigation structure are clearly investigated, emphasizing the necessity of the independence of police criminal investigation power. Korean prosecutor have absolute power in the field of criminal justice from investigation to court process. But korean police investigator have not so much power like the prosecutor. Then laws and regulations should be modified or enacted and the police and the prosecution have to do collaborate with each other. We have to give the police criminal investigation power, and set a suitable range of such independence. If the police have independent investigation power, we also can acquire benefits such as protections of human rights, increasing investigation quickliness and efficiency, realization of ideal balance between political power and agencies, evident saving costs of criminal process and investigation. Through the relation, discomfort and inconvenience due to the double investigation of people can be reduced. The prosecution can work more intelligent crimes for which a high level of law knowledge is required thanks to reduction of work assignments through investigation division with the police. To achive the purpose of this study, Chapter Ⅱ dealt with necessity of police independent investigation. In Chapter Ⅲ deals with examine relation pf the high developed conturies prosecutor and police. In Chapter Ⅳ deals with conference of investigation power independence. In Chapter Ⅴ deals with plain of the police investigation power independence. In Chapter Ⅴ concludes new images of korean police investigation power independence all the aspects discussed above.
