警察權 發動과 警察廳長의 責任限界에 관한 硏究

Abstract

과거 권위주의시대와 달리 오늘날 민주주의 사회에서는 국민들이 평화적인 수단을 통해 자신의 권리를 주장할 수 있게 되었다. 그럼에도 불구하고 21세기 대한민국 수도 서울에서는 여전히 쇠파이프와 죽창, 볼트총 등이 난무하고 있다. 경찰이 집단이기주의를 법과 원칙에 따라 엄하게 다루지 않으면 지금 우리 사회는 공중분해 될 지경에 이르렀다는 지적까지 나오고 있다. 21세기는 이익집단간의 첨예화된 갈등을 슬기롭게 조정해 나가야 하는 고도의 법치주의 사회인데 여기에서 고도의 치안능력을 필요로 한다. 그런 의미에서 이 시대는 과거보다도 법을 집행하는 경찰에게 훨씬 더 정확하고 합리적인 판단 능력을 요구하고 있다. 경찰이 합리적인 중재자로서의 역할을 충실히 수행하려면 철저하게 법과 원칙에 따라 불법행위를 엄단하고 합법적인 범위 내에서 표현의 자유를 보장해야 한다. 그러나 우리사회는 여전히 경찰에 대한 신뢰가 부족하고, 경찰 역시 소신껏 일하지 못하는 분위기가 만연하다. 경찰의 법집행과정에서 문제가 생길 경우 국민들뿐만 아니라 경찰 내부에서조차 경찰청장에게 모든 책임을 묻는 것을 당연하게 받아들이고 있다. 치안정책의 최고 책임자라고 할 수 있는 경찰청장은 대규모 집회 및 시위가 있을 때마다 유언장을 써두고 전장에 임하는 장군과도 같은 심정일 것이다. 경찰책임자에 대한 문책과 경질은 문제를 가장 쉽게 풀 수 있는 방법이지만, 이로 인해 법질서를 유지하고 법을 집행하는 경찰관들의 사기가 저하되고, 법집행의 기준이 모호해지고 이로 인해 국민들의 신뢰가 떨어지게 되는 악순환의 원인이기도 하다. 지금 우리 사회의 가장 시급한 일은 법과 원칙을 바로 세우는 일이다. 정치권에서부터 일반 시민에 이르기까지 소소한 법 위반을 융통성 있는 사회생활로 오인하고 있는 것은 큰 문제이다. 노사분규 등 각종 집회 시위 현장에서 불법폭력 시위자들이 마치 의혈열사와 같이 행동하며 민주적 정통성을 갖는 국민의 경찰에 대하여 쇠파이프 등 불법무기를 휘두르는 광경을 더 이상 방치해서는 안 된다. 우리사회 전반의 공권력 경시풍조의 최대 피해자는 결국 국민이 되기 때문이다. 우리는 경찰의 위상과 권위를 바로 세워 우리 사회의 법치주의를 공고히 하고 모든 국민의 기본권과 편안한 삶을 보장할 수 있는 민주주의의 아름다운 질서를 확립해야 한다. 이를 위해서는 경찰이 법을 해석하거나 정치적 상황을 고려할 때 모든 불법에 대하여 눈치를 보지 않고 국민들로부터 위임된 물리력을 최대한 행사하여 법질서를 유지할 수 있어야 한다. 경찰은 국민과 접촉하는 최일선 법 집행기관으로서 국가공권력의 상징이요 거리의 재판관이며 법치주의 초석이다. 경찰이 어떠한 권력으로부터도 눈치를 보지 않고 소신껏 일하기 위해서는 경찰책임자, 즉 경찰청장의 정치적 중립성과 독립성이 실질적으로 보장되어야 한다. 훌륭한 경찰 제도를 정착하는 일은 국민의 일상생활에 필요한 사회간접자본(SOC)을 확충하는 것과 같다. 이 논문에서는 우리 모두가 경찰을 어떤 모습으로 키울 것인지 진지하게 생각해보고자 한다.| The era of authoritarianism was different in the past. Now these days, anyone has got the right of self-assertion through the way of peaceful demonstration in a democratic society. But unfortunately violent demonstrations continue with steel pipes, bamboo spears, and hand made bolt guns even in the 21century in the capital of Seoul, Republic of Korea. Therefore it should be pointed out that if the police do not sternly crack down the group of self-interest in accordance with the legal process of law and principle, society might disintegrate in the air. Actually, the 21 century is sharply conflicted between groups of self-interest, So we should have a wise compromise between the two sides. Society requires a high degree of constitutionalism and a high capability of legal police power for public security. Therefore, now these days there is a need for more exact judgement ability and more reasonability in the invocation for the legal police power than before. The police are there in order to play a role as reasonable mediator and they should protect the liberty of expression in the scope of legal activity. as long as abiding to the rule and principle. If there is violation of a law, then the police have to crack down to end the illegal activity. But, the police still lack of the confidence in our society. And truth to say, the police themselves also thinking they do not stand on sure ground. Moods are spread far and wide. If the police cause an unexpected accident during the exercise of legal police power at a public demonstration. most of the people accept that is reasonable to demand the police commissioner to take responsibility. Even though, police society is prepared to admit reasonable punishment. So to speak, the police commissioner is control tower for the public security. None the less, the police commissioner has to control the mass public demonstration every time. He needs to behave as if he of a written handbook, as if he is going to the field of battle just like a general. The best way of solve the problem by replacing the police commissioner with another or demanding he take responsibility for his duty. But at the bottom of the problem is the maintenance of public order and how to invoke legal police power. Not only has the police morale plummeted, but the principal of the law is also When the invocation of legal police power, but also the confidence from the people is low, the vicious circle repeats itself. The most important thing is the police have to hold a phase and an authority, and the most difficult problem is from the political arena to the ordinary citizens. Furthermore most people misunderstand that a minor violation of law they was just an insignificant happening. We should not leave this matter allowing this to foster. That will only make it worse that the situation of violence in a labor-management dispute those who are leading just like a king incite the unlawful violence of demonstrators, and the use of iron pipes and illegal weapons against the police. Because of the mood of negligence about the public power, the final victims are the people. We need urgently to erect good democratic order and the rule of law for protecting all the people's security, basic human right and make a welfare state. In order to achieve this the police should consider the political situation and the strict interpretation of law. The police are a law enforcement agency, the symbol of public power, a judge in the road, and a foundation of legalism at the foremost of authority on the with contact with the people. In order to assure the police fairness in working for the people, there should not be any intervention from any kind of political power. The police commissioner’s public power should be guaranteed political neutrality and independence. If it is possible to establish an excellent police system, it's likely to make an enlargement of the social overhead capital for people's ordinary life. I would like to make a strong assertion in this thesis, that we should have serious thinking about how to set the invocation of legal police power.
