뇌·심혈관질환 행정처분 사례에 나타난 업무상질병 인정 관련요인 연구
- Abstract
- Total cases of 93 submitted approval for compensation against the work-related cardiovascular diseases to the Korean Labor Welfare Corporation(KLWC) were analyzed among the various variables that are known as having relations to the diseases during 2002-2003. Among 93 cases, forty six cases were approved as a compensable work-related cardiovascular diseases and forty seven cases were rejected to be compensated.
The results are as follows:
1) Among 46 cases approved for compensation by KLWC, forty one cases showed that the name of diseases were same as those listed in the Workers' Compensation Insurance Act. Only 5 cases included other name of diseases which are not listed in the Act.
2) As a result of review for the 93 cases, 38 cases recognized that there were the 'Certain Causation Relationship Factors(CCRFs)' defined in the Act. These cases were all approved for compensation by the. KLWC. From this result, the CCRFs are revealed as a critical factor to be approved.
3) According to the analysis of the relationship between approval and pre-existing diseases or conditions such as hypertensive, diabetes and hyperlipidemia, 48 cases were found to have one of these pre-existing diseases or conditions. Twenty nine cases(60.4%) were approved and Nineteen cases(39.6%) were disapproved.
4) Fifty two cases were found having individual habits or factors such as smoking, drinking and overweight among total 93 cases. Among 52 cases having individual habits or factors, 22 cases(42.3%) were approved and 30(57.7%) were disapproved.
5) While decision were made for approval and disapproval, age and sex were not considered as significant factors.
