宅地供給擴大를 위한 土地利用·開發制度
- Abstract
- This study is to analyze problems of our land use and development system such as local district system by use, selected land development system and allotment system for development and to suggest following reform measures for the land use and development system based on the analysis for selected land supply, which is the foundation of the people's lives.
First, the areas and districts categorized in same group by their purpose and controling measures should be consolidated and simplified by generally analyzing each law stipulating details on the areas and districts because it hinders and aggravates confusion on land development. About 160 areas and districts catagorized by about 70 laws are redundantly regulated or opposed in their regulation. Unresoanble restiction opposed between laws in their regulation must be reconsolidated. Land development should be systematized by giving a peculiar number according to the priority of land development, prescreening local district system introduced in order to control and restrict areas and districts thoughtlessly established and unnecessary districts definately ablished by introducing area-swaging system.
Second, because it takes too much time to transfer its use in case of quasi agricultural and forestry land, the newly established usable land, when it's developed, articles on land treatment in the land use and management law regarding the quasi agricultural and forestry land which is included in the target areas of basic urban development pland as urban district determined and announced by the land use and management law should be newly established in order to rapidly cope with the land use and to develop the land in accordance with its features by authorizing the power for regulating that is strengthened to prevent development of quasi agricultural and forestry land in disorder to the local self-governing body. The land supply system, which is for using the quasi agricultural and forestry land by plans, should also be complemented to control land use and supply through close investigation for demand and supply on selected land.
Third, the land supply should be smoothly made by activating participation of private enterprises in land development project. The city development law to induce participation of private enterprises should be established by consolidating development projects stipulated by existing each law that fundermentally regulates involvement of private enterprises in long term base. On the other hand, development by private enterprises should be induced by designating target area for development in accordance with the housing construction promoting law and make private developmental enterprises actively participate in the land development to increase selected land supply by seeking ways to release compulsive requirement of establishing main lines regulated by local self-governing body in short term base.
Forth, objectified developmental expenditure calculation standard should be provided because the exceeded cost is not fundermantally allowed in calculation with the governmental project cost accounting method when the project cost presented by private projectors is exceeded normal project cost level. Progressive taxation should be applied on the target land according to its project scale and feature. Currently 50% of obligatory tax rate is uniformly imposed on the target land. Various allotments along with developmental allotment which are potentially redundant tax imposition should be adjusted for land supply in smooth by lessening developer's financial burden.
