초국가적 범죄조직인 삼합회에 대한 연구

Abstract

정보화의 급속한 진행과 교통수단의 발달에 따라 국가간의 인적·물적 교류는 늘어나고 그 유형도 다양해지고 있다. 이에 따라 바람직하지 못한 현상으로 범죄문제도 국제적인 문제로 되고 있다. 더욱이 우리 한반도 주변의 거대 국제범죄조직인 중국 삼합회가 일본의 야쿠자, 러시아 마피아 보다 대형화, 전 문화, 친밀화 등 다양한 형태로 세력을 확장하고 있으며, 특히 홍콩반환 이후 단순범죄 조직에서 국가 안보를 위협하는 "초국가적 범죄 조직(TC:Transnational CIime)"으로 부상하고 있어, 동북아시아 중심지역으로 떠오르고 았는 우리나라로서는 삼합회조직의 활동에 심각한 우려를 낳고 있는 현실이다. 제1장 중국과 물적, 인적 교류가 급격히 증가하면서, 삼합회조직과 국내범죄조직과의 연계체제를 구축하여 거점 확보 및 사업 확장을 위한 국내침투사례가 빈번한 것을 볼 때 삼합회조직에 대한 우리의 인식을 제고하지 않을 수 없다. 따라서 그들의 실체와 범죄유형을 심도 있게 살펴보고, 우리의 국제조직범죄에 대한 기관별 대응책과 문제점을 분석하여 새로운 국제조직범죄에 대한 개념 정립이 요구된다. 그러므로 본 논문은 아시아의 최대 국제조직범죄 삼합회에 대해서 국내·외 각종 문헌조사와 기관별 범죄백서, 그리고 홍콩경찰 내부 자료를 비교하는 기술적 연구방법으로 진행하였다. 제2장에서 국제범죄조직의 정의와 개념을 고찰하였다. 국제범죄조직을 일반적인 개념과 국제법적 개념으로 해석하고 있다. 일반적으로 경제적인 이익의 추구가 최우선 과제로 여겨 목적 달성을 위한 수단과 방법이 다양하고 활동 영역이 매우 넓으면서 친밀한 계획을 수립하는 것이다. 국제법적개념은 국제범죄의 조직이라는 뜻과 국제적인 조직범죄라는 두 가지 해석으로 표현하고 있다. 따라서 본 논문에서는 UN국제법위원회와UN국제조직범죄협약을 중심으로 서술하였다. 제3장에서는 본 논문의 중심인 삼합회 실체에 대하여 집중 분석하였다. 삼합회가 출현하게 된 사회적 배경과 구도 그리고, 시대적 변화를 통해서 국제범죄조직으로 부상하게 된 과정을 살펴보았다. 제4장에서는 오늘날 삼합회의 중심세력 집단인 홍콩삼합회에 대해서 집중 분석하였고, 또한 홍콩정부의 대응책과 대응기구의 역할에 대해서 살펴보았다. 제5장에서는 국제범죄조직에 대한 우리의 대응책과 문제점에 대해서 기관별로 비효율적인 수사체계를 지적하였고, 또한 효과적이고 일원화된 수사공조 통합시스템의 필요성에 대해서 제안을 제시하였다. 제6장 결론에서는 우리나라가 아시아의 물류 중심지역으로 부상됨에 따라 이에 따른 국제 범죄 집단(삼합회)의 범죄행위(마약밀매, 위조여권, 밀수, 인신매매..)가 단순 범죄 집단 수준을 넘어 초국가적 범죄 집단(TC)으로 부상됨에 따라 우리의 국제 범죄 집단에 대한 개념 재정립이 절실히 요구되고 특히 국회에 발의중인 국정원 관할 "테러방지법"이 하루 속히 법적 효력을 가질 수 있는 국가적 차원의 결단이 무엇보다 중요하다고 할 것이다.|Since modern societies characterise in overriding information and continuous development of transportation methods, international exchanges have boomed and their forms are much more various. The downside of increasing international exchanges is that problematic situations are also booming, such as crime. The Chinese Triad, an international crime organization of a massive size, has been expanding greatly in comparison to the Japanese Yakuza and the Russian Mafias. The triad is now no longer a single crime organization but a transnational crime organization that is a real threat to a nation's security, particularly the situation worsened after the return of Hong Kong from Britain to China. As Korea has seen its personal and material exchanges with China increase drastically, the Chinese triad and the Korean counterpart have also tried to establish networks to ease and expand their business, and thus promoting a new understanding of the triad is crucial. The research studies the essence of the triad and the cases of crimes committed, and analyses our countenneasures of each governmental organ and their problems. The research refers to various sources, domestic and foreign, and criminal white papers from governmental organs, compares those with inside materials from Hong Kong police. The chapter 2 discusses the definition and the concept of an international crime organization. Making economic profits as a priority, planning crimes in diverse areas with no restrictions on how to achieve the priority is the general concept of an international crime organization. The concept on the context of international law is expressed into 2 different interpretations; an organization of international crime and organizational crime that is international. Therefore, the research referred to International Law Commission of the United Nations and' United Nations Convention against Transnational Crime. The chapter 3 analyses the essence of the triad, the main topic of the research. The chapter 3 looks at the social background which gave birth to the triad and, how the triad emerged as an international crime organization. The chapter 4 analyses the core of the Chinese triad, the Hong Kong triad. The countenneasures of Hong Kong government and the roles of each governmental organs are also analysed in the chapter 4. The chapter 5 criticises our countermeasures against international crime organizations, particularly the inefficient structure of investigation. The chapter argues the need of a unified investigative system. The chapter 6 concludes that transnational crime organizations such as the Chinese triad are a serious threat to the national security especially when our country is emerging as Asia's hub of material exchanges, that a new understanding of international crime groups is essential and the antinterrorist bill proposed by NIS(National Intelligence Service) must come into legal force as soon as possible.
